1. Acceptance of Terms

Welcome to JLC Counseling and Wellness DBA JLB Wellness Collective (doing business as "JLC Consulting and Wellness," "we," "us," or "our"). By accessing or using our website [jlcwellnesscollective.com] (the "Site") or participating in our programs and services, you agree to be bound by these Terms and Conditions ("Terms").

Please read these Terms carefully before using the Site or our services.

If you do not agree to these Terms, you may not access or use the Site or participate in our programs.

For Minors: If you are under 18 years of age, your parent or legal guardian must review and accept these Terms on your behalf before you may use the Site or participate in our programs.

Mission:
We provide holistic wellness programs, character development, life skills training, marriage enrichment, and community support services to individuals, couples, families, and youth in Douglas County, Colorado.


3. Use of the Site

3.1 Permitted Use

You may use the Site for lawful purposes only, including:

  • Learning about our programs and services
  • Submitting inquiries and interest forms
  • Registering for programs (when available)
  • Making donations
  • Accessing resources and information
  • Subscribing to our newsletter

3.2 Prohibited Conduct

You agree NOT to:

  • Use the Site for any unlawful purpose
  • Violate any local, state, federal, or international law
  • Infringe on intellectual property rights
  • Transmit viruses, malware, or harmful code
  • Attempt to gain unauthorized access to our systems

4. Program Registration and Participation

4.1 Registration Process

Current Process:
At this time, program registration is conducted through inquiry/interest forms submitted via the Site. Our team will contact you to complete the registration process.

Future Process:
We plan to implement direct online registration and payment processing. These Terms will be updated to reflect that process when available.

4.2 Eligibility

Program eligibility varies by program type:

  • Youth Programs (Ages 13-25): Require parental/guardian consent for participants under 18
  • Adult Programs: Open to individuals 18 and older
  • Couples Programs: Open to married or committed couples
  • Community Assistance: Available to families in need meeting eligibility criteria

We reserve the right to determine participant eligibility and suitability for programs through our application and interview process.

4.3 Participant Conduct

Program participants agree to:

  • Attend scheduled sessions consistently
  • Participate respectfully and constructively
  • Respect confidentiality of other participants
  • Follow facilitator guidance and program rules
  • Refrain from disruptive or harmful behavior
  • Provide accurate information during registration

We reserve the right to dismiss participants who:

  • Violate program rules or terms
  • Engage in disruptive, disrespectful, or harmful behavior
  • Pose a safety risk to themselves or others
  • Fail to meet attendance requirements

Dismissal for conduct violations does not entitle participants to refunds.

4.4 Parental Consent for Minors

For all programs involving participants under 18 years of age:

  • A parent or legal guardian must complete registration
  • Parents/guardians must provide emergency contact information
  • Parents/guardians consent to program activities and policies
  • Parents/guardians are responsible for transportation to/from programs
  • Parents/guardians may be contacted regarding participant behavior or concerns

5. Fees, Payments, and Donations

5.1 Program Fees

Program fees vary by program type and are clearly stated on each program page. Fees cover:

  • Instructional materials and resources
  • Facilitator and mentor services
  • Program activities and supplies
  • Administrative costs

Payment Processing:
Payments are processed securely through third-party payment processors (Stripe, DonorBox, or similar). We do not store your complete payment information on our servers.

5.2 Donations

Donations to JLC Consulting and Wellness support our mission and programs. Donations may be:

  • One-time or recurring
  • Designated for specific programs or general operating support
  • Made online through secure payment processing

Tax Deductibility:
[Upon grant of 501(c)(3) status:] Donations to JLC Consulting and Wellness are tax-deductible to the extent allowed by law. You will receive a donation receipt for tax purposes.

[Current status:] 501(c)(3) status is pending. Tax deductibility status will be updated once granted.

5.3 Refund and Cancellation Policy

Program Registration Refunds:

Program fees are refundable under the following conditions:

  • Within 48 hours of purchase: Full refund available
  • 30 days or more before program start date: Full refund available
  • Less than 30 days before program start: No refund (to accommodate planning and facilitator commitments)

Whichever comes first applies. Example: If you register 20 days before a program starts, you have 48 hours from purchase to request a refund.

  • Include your name, program name, and registration date
  • Refunds will be processed within 7-10 business days

Exceptions:

  • Refunds may be granted outside these windows in cases of documented emergency or extenuating circumstances at our sole discretion
  • Participants dismissed for conduct violations are not entitled to refunds
  • Administrative fees may apply to refund processing

Donation Refunds:

All donations are final and non-refundable unless:

  • A processing error occurred
  • The donation was made fraudulently or without authorization
  • Required by law

6. Intellectual Property

6.1 Ownership

All content on the Site, including but not limited to text, graphics, logos, images, videos, program materials, and software, is the property of JLC Consulting and Wellness or its licensors and is protected by copyright, trademark, and other intellectual property laws.

6.2 Limited License

We grant you a limited, non-exclusive, non-transferable license to access and use the Site for personal, non-commercial purposes only. You may not:

  • Reproduce, distribute, or publicly display Site content without permission
  • Modify, create derivative works, or reverse engineer any Site content
  • Remove copyright or proprietary notices
  • Use our name, logo, or branding without written permission

6.3 User-Generated Content

If you submit content to us (testimonials, feedback, photos, etc.), you grant us a non-exclusive, royalty-free, perpetual, worldwide license to use, reproduce, modify, and display that content for our organizational purposes, including marketing and promotional materials.

You represent that you own or have rights to any content you submit and that it does not violate any third-party rights.


7. Privacy and Data Protection

Your privacy is important to us. Our collection, use, and protection of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

8. Safety and Background Checks

8.1 Staff and Volunteer Screening

All staff members, mentors, facilitators, and volunteers who work with program participants, especially minors, undergo:

  • Comprehensive background checks
  • Reference checks
  • Training appropriate to their role
  • Ongoing supervision and evaluation

8.2 Safety Protocols

We implement safety protocols including:

  • Mandatory reporting of suspected abuse or neglect
  • Emergency procedures and contact protocols
  • Supervision ratios appropriate to program type
  • Facility safety standards

8.3 Participant Safety

While we take reasonable precautions to ensure participant safety, program participants and their families acknowledge that:

  • Some programs involve physical activity or new experiences
  • We cannot guarantee absolute safety or prevent all injuries
  • Participants should disclose health conditions or concerns that may affect participation
  • Emergency medical treatment may be sought if necessary

9. Disclaimers and Limitations of Liability

9.1 No Professional Services

Important Notice: JLC Consulting and Wellness programs are educational, developmental, and supportive in nature. Our programs are NOT:

  • A substitute for professional mental health counseling or therapy
  • Medical advice or treatment
  • Legal or financial advice
  • A guarantee of specific outcomes or results

If you need clinical mental health services, we encourage you to seek care from a licensed mental health professional.

9.2 Disclaimer of Warranties

THE SITE AND OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not warrant that:

  • The Site will be uninterrupted, secure, or error-free
  • Information on the Site is complete, accurate, or current
  • Defects will be corrected
  • The Site is free from viruses or harmful components

9.3 Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, JLC CONSULTING AND WELLNESS, ITS DIRECTORS, OFFICERS, EMPLOYEES, VOLUNTEERS, AND AGENTS SHALL NOT BE LIABLE FOR:

  • ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
  • LOSS OF PROFITS, DATA, USE, OR GOODWILL
  • SERVICE INTERRUPTIONS OR DATA LOSS
  • PERSONAL INJURY OR PROPERTY DAMAGE
  • ANY DAMAGES ARISING FROM YOUR USE OF THE SITE OR PROGRAMS

EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU EXCEED THE AMOUNT YOU PAID TO US IN THE SIX MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.

Some jurisdictions do not allow limitations on warranties or liability, so these limitations may not apply to you.


10. Indemnification

You agree to indemnify, defend, and hold harmless JLC Consulting and Wellness, its directors, officers, employees, volunteers, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or related to:

  • Your use of the Site or services
  • Your violation of these Terms
  • Your violation of any rights of another person or entity
  • Your conduct in connection with our programs
  • Any content you submit or transmit through the Site

11. Third-Party Services

11.1 Payment Processors

We use third-party payment processors (Stripe, DonorBox, or similar) to handle financial transactions. Your payment information is subject to the privacy policies and terms of these third-party providers.

11.2 Email and Communication Services

We use third-party services (such as Mailchimp) for email communications. Your information shared with these services is subject to their privacy policies.

11.3 Other Third-Party Services

The Site may integrate with or link to third-party websites, services, or tools. We are not responsible for the practices, content, or terms of these third parties. Your use of third-party services is at your own risk.


12. Governing Law and Dispute Resolution

12.1 Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Colorado, without regard to conflict of law principles.

12.2 Jurisdiction and Venue

Any legal action or proceeding arising out of or related to these Terms or your use of the Site shall be brought exclusively in the state or federal courts located in Douglas County, Colorado. You consent to the personal jurisdiction of these courts.

12.3 Dispute Resolution

Informal Resolution:
Before initiating any legal action, you agree to first contact us to attempt to resolve the dispute informally. Contact us at info@jlcwellnesscollective.com with a description of the dispute.

12.4 Class Action Waiver

TO THE EXTENT PERMITTED BY LAW, YOU AGREE THAT ANY DISPUTE WILL BE RESOLVED INDIVIDUALLY AND NOT AS A CLASS ACTION, CONSOLIDATED ACTION, OR REPRESENTATIVE ACTION.


13. Changes to These Terms

We reserve the right to modify these Terms at any time. Changes will be effective when posted on the Site with an updated "Last Updated" date.

Material changes will be communicated by:

  • Posting a notice on the Site
  • Sending an email notification (if you have provided your email address)

Your continued use of the Site or participation in programs after changes are posted constitutes acceptance of the modified Terms.

If you do not agree to the modified Terms, you must stop using the Site and discontinue participation in programs.


14. Termination

14.1 Termination by You

You may stop using the Site at any time. If you wish to cancel program participation, our refund and cancellation policy applies (see Section 5.3).

14.2 Termination by Us

We reserve the right to:

  • Suspend or terminate your access to the Site at any time for any reason
  • Discontinue programs or services with reasonable notice
  • Remove participants from programs for violations of these Terms or program policies

Termination does not affect any rights or obligations that arose before termination.


15. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect to the maximum extent permitted by law.


16. Waiver

Our failure to enforce any provision of these Terms does not constitute a waiver of that provision or our right to enforce it in the future.


17. Entire Agreement

These Terms, together with our Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and JLC Consulting and Wellness regarding your use of the Site and services.


18. Assignment

You may not assign or transfer these Terms or any rights granted hereunder without our prior written consent. We may assign these Terms without restriction.

20. Acknowledgment

BY USING THE SITE OR PARTICIPATING IN OUR PROGRAMS, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS AND CONDITIONS.

For Minors: By registering a minor for our programs, you acknowledge that you are the parent or legal guardian with authority to accept these Terms on behalf of the minor.
